A kutatási téma leírása:

The theory and practice of human rights – or fundamental rights – form a current topic of constitutional law in the 21st century. The catalogue of fundamental rights, as an open system, enables the acknowledgment and declaration of more and more rights on the domestic, supranational and international level. Alongside the appearance of new fundamental rights, the scope of ‘traditional’ rights conceptualized in the past decades or centuries has been broadened or modified as well. Examining the causes of this transformation and enrichment, we can identify the phenomenon of globalization, massification, pluralisation, interdependence and the fragmentation of society as the main reasons of the development of new interpretations, scopes and even limitations of certain rights. Many of the social sciences experienced a change of paradigm in the past decades, the new theories, approaches and frameworks, however, have not been implemented into the legal regulation yet. The perceivable exponential development in the field of science and technology is reflected in human rights issues that continuously challenge legal practice and jurisdiction.
Changes touch upon almost every fundamental right, some of them, however, are in need of particular attention: the right to life and human dignity, the right to respect for private and family life, freedom of conscience and religion, prohibition of discrimination, children’s rights, rights of employers and workers, the right to social security, the right to health and a healthy environment.
The offered doctoral programme emphasizes the importance of multidisciplinary approaches – devoting particular attention to psychology, sociology, philosophy and life sciences – and explicitly facilitates research and results aimed at the harmonization of the paradigms of jurisprudence with other areas of science, establishing proposals for a more topical and effective regulatory framework. This approach provides the possibility of interdisciplinary cooperation already during the doctoral studies and supports research within the Faculty of Law for non-lawyer graduates as well.
