The economic crisis that spread through the world and reached the Central European Countries in 2008 rendered the repayment of banking loans indexed in foreign currencies, mostly in CHF at the time, even more difficult. The unstoppable tendency of weakening of domestic currencies vis-à-vis CHF led to an immense increase in the sums of the monthly credit instalments payable in local currency, as the exchange-rate of the CHF skyrocketed. The fiasco of credit transactions has threatened all, but most of all consumers, who took long term loans usually in order to acquire residential property and satisfy their basic housing needs. The growing number of non-performing loans inevitably led to an increase in the number of the court proceedings in which the consumers made attempts to have the loan contracts declared null and void or to have them at least rescinded on grounds of changed circumstances. The CEE countries took different approaches in redressing the ever-growing number of disputes concerning consumer credit contracts. At first, the task of resolving the difficulties in relation to consumer credit contracts fell on the courts, but later the legislature
intervened in as good as in all CEE countries. However, there
are differences in the paths that were taken in these countries. The aim of the prospective thesis is to map these differences in the standpoints of the case law and measures introduced by the legislature, and draw a conclusion which measures proved to be the most efficient.
