II. Different regulatory frame of conformity and guarantees in consumer sales contracts in the CEE countries

A kutatási téma leírása:

The aim of the Directive 1999/44/EC on certain aspects of the sale of consumer goods and associated guarantees was to harmonise the national regulations on conformity of goods and related guaranties in consume sale contracts. The majority of CEE countries that joined the
European Union in 2004 implemented the Directive into their national legal order by 2002 which was the deadline for its transposition. Romania, Bulgaria and Croatia, who acceded to the European Union much later, also transposed the Directive in the course of harmonisation of their national legal orders with the acquis communautaire. A notable example is Serbia, which is still not a member of the European Union, but harmonised the national rules with the Directive already in 2010, when the second statute on the protection of consumers was promulgated. The transposition of the Directive 1999/44/EC in CEE countries took two different courses. On the one hand, in some countries the rules of the Directive have been transposed by amending the general rules of contract law. A clear example in this respect is Hungary, which transposed the Directive by amending the Civil Code from 1959. On the other hand, there are countries that did amend the general rules of contract law, but rather implemented the rules of
the Directive in a special statute, regularly in the one pertaining to the protection of consumers. A weakness of the latter approach may be that by parallel regulation of conformity and guarantees by the rules of general contract law and in the consumer protection act, the issue of
delineating their scope of application inevitably arises. The aim of the proposed research is to shed light on the different legislative approaches adopted in CEE countries regarding the transposition of the Directive 1999/44/EC. The topicality of this question is supported by the fact that a new Directive (EU) 2019/771 has been adopted in 2019, whereby the deadline for its transposition expires in July 2021 and begin to apply as of January 2022.
