Description of the research topic:

The topic includes the historical development of certain legal instruments of asset management, from Roman legal institutions (fiducia cum amico, fideicommissum, etc.), through its medieval forms (Salmman, wakf, trust, etc.) to today’s legal regulations and case law. The central issue of the topic is the analysis of the different types of use of the Anglo-Saxon trust, its adoption in civil and mixed legal systems, and the development of legal constructions similar to a trust. The relationship between the forms of asset management and corporate law institutions provides an interesting comparison, but the research itself can also focus on the historical and comparative law analysis of company law. Nowadays, we are experiencing significant efforts in the field of establishing legal institutions similar to trusts, and comparative legal research is also possible in this area. It is also possible to compare the fiduciary asset management legal relationship institutionalized in Hungarian private law, the asset management foundation, the capital funds and certain types of companies. The research mainly covers dogmatic issues of private law, its other aspects, such as its relationship with inheritance law, family law and administrative and tax issues, can also be included in the processing of the topic.
