Description of the research topic:

In the past 2-3 decades, the “Western type” legal systems that were formed in the 19th century have faced several challenges. One of these challenges is the explosive expansion of cross-border commercial and other transactions, which forced the legislators and the jurists to face the fact that the legal paradigm of national state are untenable. The contracts of the multinational firms formed such new legal materials that were not created based on the traditional methods of law-making. Economic interests and resources behind the international commerce also represent power, which can be a rival of the authority of the state’s legislative power. This situation gives an opportunity for multidimensional theoretical analysis of varied methods, too. How does the above-mentioned development effect our picture about the concept of law or our traditional interpretation of law? What kind of political-philosophical framework can be used in order to evaluate the changes? How does the traditional mechanism of validation and enforcement of law change? How does globalization affect the concepts and system of commercial law? In which family of law can supranational commercial law be classified?
