Az Ogytv. hatályba lépésével a modern magyar parlamenti jog régi hiányosságát orvosolta a jogalkotó: megteremtette a "valódi" fegyelmi jogi intézményrendszert. A fegyelmi jog gyakorlata azonban számos kérdést napvilágra hozott: AB- és EJEB-döntések is tanúskodnak. Az alkalmazással felmerülő új kérdések a fegyelmi jog újraszbaályozását is indokolta. A téma alkotmányjogi jelentősége ellenére monografikus feldolgozására még nem került sor.
